1.What is this privacy policy about?

Finanz Fuchs GmbH (hereinafter "we", "us" or "the Company") advises on, brokers and administers solutions in the areas of pension planning, insurance, financial and tax matters, and asset management. In doing so, we process personal data of our clients, of prospective clients, of visitors to our website and client portal, and of other persons with whom we are in contact (hereinafter "you").

This privacy policy describes which personal data we process for which purposes, to whom we disclose it and what rights you have. In individual cases we additionally inform you separately about a processing activity, for example in forms, in the mandate agreement or when using individual services.

If you provide us with data about other persons (for example family members, beneficiaries or representatives), we assume that you are authorised to do so, that the data is accurate and that you have informed those persons about the disclosure.

2.Who is responsible for processing your data?

3.What data do we process and for what purposes?
Categories of personal data
  • Master data: name, address, date of birth, contact details, marital status and similar identification and contact data.
  • Contract and mandate data: services used, correspondence, powers of attorney, declarations of consent and data on the use of the client portal.
  • Financial data: income, assets, pension situation, existing insurance and tax-relevant information. Financial data is ordinary personal data.
  • Health data, where required for pension and insurance solutions. Health data is sensitive personal data within the meaning of Art. 5 lit. c FADP.
  • Usage and log data of the client portal and the website, for example logins, time and type of use, and technical log data.
Purposes of processing
  • Advice, brokerage and administration within the mandate, including the assessment of your needs and circumstances.
  • Initiation and execution of contracts with product providers (insurers, banks, pension institutions).
  • Compliance with legal and supervisory obligations, in particular under financial services, insurance supervision and anti-money-laundering law, as well as tax and accounting law.
  • Operation, security and further development of our client portal and website.
  • Communication with you, including responding to enquiries.
  • Information about our own services, unless you object.
  • Safeguarding legitimate interests, in particular enforcing or defending claims, preventing misuse and managing the business.
4.On what basis do we process your data?

We process personal data on one or more of the following bases:

  • Performance of the mandate agreement and pre-contractual measures at your request. This is the basis for processing the data required for the advice, including health data to the extent you provide it to us within the mandate.
  • Legal and supervisory obligations to which we are subject.
  • Overriding private or public interests, in particular the security of our services, information about our own services, and the protection or defence of claims. You may object to such processing.
  • Express consent, where required, in particular for the disclosure of health data to insurers. You may withdraw consent at any time with effect for the future.
5.Where does the data come from?
  • From you: We collect most of the data directly from you, in the course of the mandate assessment, the use of our portal or communication with us.
  • From third parties: Where required for the service, we receive data from product providers, from authorities or from publicly accessible sources.
6.To whom do we disclose your data?

In connection with the purposes stated above, we disclose personal data in particular to:

  • Product providers (insurers, banks, pension institutions) for the initiation and execution of contracts.
  • Authorities and courts, where we are legally or under supervisory law obliged or entitled to do so.
  • Engaged auxiliary persons subject to confidentiality and data protection obligations.
  • Processors that process data on our behalf.

We use carefully selected service providers that process personal data on our behalf and in accordance with our instructions. We conclude a data processing agreement with each processor.

7.Is your data transferred abroad?

We process and store personal data primarily in Switzerland. A transfer abroad takes place only where the country concerned offers an adequate level of data protection, where suitable safeguards ensure an adequate level of protection (in particular standard contractual clauses), or where a statutory exception applies.

8.How long do we retain your data?

We retain personal data for as long as is necessary for the respective purposes, for the duration of the business relationship and to comply with statutory retention periods. The data is then deleted or anonymised.

9.How do we protect your data?

We take appropriate technical and organisational measures to protect your personal data against unauthorised access, loss and misuse, and we adapt these measures on an ongoing basis.

10.Is there automated decision-making or profiling?

We may evaluate information on your personal and financial circumstances in order to tailor our advice to your needs. Such an evaluation may constitute profiling within the meaning of Art. 5 lit. f FADP. We do not take decisions based solely on automated processing that produce legal effects concerning you or significantly affect you.

11.What rights do you have?

Within the scope of applicable law, you have in particular the following rights:

  • Access to the personal data we process.
  • Rectification of inaccurate data.
  • Deletion and restriction of processing.
  • Objection to certain processing.
  • Release or transfer of certain data in a common electronic format.
  • Withdrawal of consent given, with effect for the future.

To exercise these rights, please contact the office named in section 2. The information is generally free of charge and is usually provided within 30 days. To prevent misuse, we may need to identify you. These rights may be subject to conditions, exceptions or restrictions, in particular to protect third parties or due to legal obligations.

You also have the right to lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC).

12.Cookies and similar technologies on our website

When you use our website and client portal, technical data is generated and stored in logs. We use cookies and similar techniques to ensure the functionality and security of our services. You can set your browser to reject, accept or delete cookies.

If in future we use non-essential cookies or services for reach measurement and analytics, for example Google Analytics, we will do so only with your prior consent, which you may withdraw at any time with effect for the future. Such services receive no data from the protected client portal and no sensitive personal data.

13.Can this privacy policy be amended?

We may amend this privacy policy. The version published on our website and in the client portal at the relevant time applies.
